Here on are the terms and conditions on which you may order the products available on this Website.
In these Terms, when we refer to "we", "us" or "our", we mean the Company
‘Turkish Best Kebab.; and when we refer to "you" or "your" we mean you,
the person accessing or using the Websites.
1. Information about us
1.1 Turkish Best Kebab Ltd. is a company registered in England and Wales
under company number 07596170, with its registered office at 2 Todmorden Rd, Burnley, BB10 4AE.
2. Ordering Products
2.1 You may order Products online directly from us via this Website if you wish to collect your products (“Collection Orders”) or for home delivery by us (“Delivery Orders”).
2.2 You must be at least 18 years old to place an order online.
2.3 In order to place an Order for delivery or collection on the Website, you will need to provide certain details requested on the site, this information will only be used to process the order or contact you if we have any queries on your order.
2.4 Once your order has been placed we will confirm acceptance of your
order which you will receive confirmation on-screen as well as an email
confirming the information you included in your Order. The Order will
become legally binding on you and us when we accept the order and send you
the email confirmation.
3. Collection
3.1 Collection time will be set out during the ordering process.
3.2 If you do not collect your Order within one hour of your collection
time, your Products will be disposed of and you will not receive a refund.
4. Delivery
4.1 All delivery times are estimates and the actual delivery time may vary from this estimate. You should also be aware that if you request and we agree to change your delivery address following submission of an Order this may lead to a significant delay in your delivery time.
4.2 If, during delivery of an Order, you fail to take delivery of the order
within ten minutes of our delivery driver's arrival, the order will return
back to us and you will not receive a refund, also we will not be liable to
a secondary delivery attempt
5. Payment
5.1 The prices for the Products and for delivery are set out on the website. Please note that if your Delivery Order is below a minimum value then an additional charge, as set out on the website during the ordering process, may also apply.
5.2 Some of the Products may be incorrectly priced. If the Product's price at the time of your order is higher than the price stated to you, we will contact you for before we accept your Order. If we accept your order where a pricing error is obvious and unmistakeable and could reasonably have been recognised by you as a mispricing, we may end the contract and refund you any sums you have paid.
5.3 If your payment is not authorised, your order will not be sent to us
and we will not fulfil your order.
6. Cancellation and refunds
6.1 You do not have a right to cancel any contract for Products under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulation 2013.
6.2 You may request that your Order is cancelled or changed after it has been submitted, but this will only be possible before we have received the Order or starting making your order. No refund will be provided if you cancel the order after it has been received and being made.
6.3 If you cancel your Order, your original payment will be processed and thereafter we will provide a refund.
6.4 If we are unable to fulfil your Order or any of the Products in a
particular Order, we will refund the value of the Product(s) that we were
unable to fulfil and, if the full Order is cancelled, any delivery and
service charges.
7. Our liability
7.1 Nothing in these Terms excludes or limits our liability for:
7.1.1 death or personal injury caused by our negligence;
7.1.2 fraud or fraudulent misrepresentation; and
7.1.3 any matter in respect of which it would be unlawful for us to exclude or restrict our liability.
7.2 Nothing in these Terms affects your statutory rights. Advice about your
statutory rights is available from your local Citizens' Advice Bureau or
Trading Standards Office.
8. Changes to these Terms
8.1 We may make changes to these Terms and Conditions from time to time.
Terms applicable at the time of your Order will apply to that Order. Please
check these Terms regularly to ensure that you understand the Terms that
apply at the time that you order the Products.
9. Governing law and jurisdiction
9.1 These Terms are governed by the laws of England and Wales. This means
that your order and any dispute or claim arising out of or in connection
therewith will be governed by English law.
